PA DUI law usually triggers two separate cases: a DUI court case and a PA Department of Transportation (PennDOT) case. When drivers are arrested for DUI in Pennsylvania, they are charged with two different counts. The first is General Impairment/Incapable of Safe Driving (Pa.C.S. 75 §3802(1); the second is a related charge of driving with a blood alcohol content (BAC) of .08 percent or higher (Pa.C.S. 75 §§3802(b),(c),(e) or Driving with Controlled Substance (Pa.C.S.§3802(d). The latter charge is the one that triggers the PennDOT case, wherein PennDOT will attempt to suspend or revoke your PA driver’s license.
